MINUTES OF BRUSLY PLANNING COMMISSION
REGULAR MONTHLY MEETING
August 28, 2002

The regular monthly meeting of the Brusly Planning Commission was held on August 28, 2002 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:30 P.M.

Members present: Jules Thibodaux, Carroll Fontenot, Rosa Stelly, Leslie Crockett, Claudette Purnell, Henry Couvillon, Debbie Thompson.

Members absent: None.

Others present: Marianne Berthelot, Don Neisler, Mayor Joey Normand, Joanne Bourgeois, Chris Kershaw, Jim Tatum & developers of Brusly Oaks Subdivision, Skipper Grady, members of the Peavy Family, members of the Alexander and Griffin Families, and a group of citizens representing the Allene Street Area.

Upon motion of Mr. Carroll Fontenot seconded by Mr. Jules Thibodaux, the minutes of the July 24, 2002 meeting were approved as written. Motion carried unanimously.

Public Hearing:

The Chairperson opened the public hearing on the request of Fontaine/Ward Properties for approval of a plat showing the re-subdivision of the Charles Marionneaux and Minta S. Marionneaux property located on the Northwest corner of LaBauve Avenue and Allene Street, into three lots.

Mr. Skipper Grady was recognized. He asked for a moratorium on subdivisions until the revisions to the Zoning Ordinance were enacted. His proposal was that the minimum lot size requirements in R-1 Zone should be reviewed (that can be done with the help of attorneys from Mergl and Wenger, Attorneys at Law) and raised to protect property values.

Mr. Don Neisler was consulted. He advised the commission that since this item is already on the agenda there is nothing to be done. By law the commission has 60 days to act on the request and no action would be in violation of state law.

There was no one present representing the owners and/or buyers.

Comments were received from several residents of Allene Street with regards to the lot sizes and the type of construction to be placed on the lots. It was made known that Mr. Ward stated at the last meeting that the homes would be around 1,600 to 1,900 Sq. Ft. Mr. Neisler advised the commission that each of the three lots would have more than ample room for this square footage and it meets all requirements.

There were questions from the audience as to the location of the property line being in the road. Since the surveyor or the owners were not present clarify the notations on the plat the members felt that they would have to defer action until they could get an answer. There were no further comments and the public hearing was closed.

Mrs. Rosa Stelly made a motion to defer action until the next meeting and re-advertise for public hearing. Motion was seconded by Mr. Carroll Fontenot and carried unanimously.

Plat Submittals:

1. Mr. Jim Tatum of Tatum Engineers submitted “Map Showing the Resubdivision of Tract X into Tracts X-1, X-2, X-3, X-4 and X-5, Portion of Additions to Cinclare Plantation Located in Section 15 & 16, T8S, R12E SLD for Harry L. Laws & Company, Inc.”

He explained the site plan stating that Tract X-1 is for out parcels; Tract X-2 is the retail portion; Tract X-3 is the location of the Supermarket; Tract X-4 is unplanned at this time and Tract X-5 is the remaining portion that is also unplanned and will be owned by H. L. Laws.

The question of traffic flow came up. Mayor Normand was recognized and he explained the plans to widen St. Francis Street.

Mrs. Rosa Stelly made a motion to advertise this request for a public hearing to be held at the next regular meeting of the commission. Motion was seconded by Mr. Carroll Fontenot and carried unanimously.

There was no other business to come before the Planning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Motion was seconded by Mr. Henry Couvillion and carried unanimously.

Meeting of the Brusly Planning Commission adjourned at 7:04 P.M.

 

MINUTES OF BRUSLY ZONING COMMISSION
REGULAR MONTHLY MEETING
August 28, 2002

The regular monthly meeting of the Brusly Zoning Commission was held on August 28, 2002 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 7:05 P.M.

Members present: Jules Thibodaux, Carroll Fontenot, Rosa Stelly, Leslie Crockett, Claudette Purnell, Henry Couvillon, Debbie Thompson.

Members absent: None

Others present: Marianne Berthelot, Don Neisler, Mayor Joey Normand, Joanne Bourgeois, Chris Kershaw, Jim Tatum, and developers of Brusly Oaks Subdivision, Skipper Grady, members of the Peavy Family, members of the Alexander and Griffin Families, and a group of citizens representing the Allene Street Area.

Upon motion of Mrs. Claudette Purnell seconded by Mr. Carroll Fontenot, the minutes of the July 24, 2002 meeting were approved as written. Motion carried unanimously.

Public Hearing:

1. The Chairperson opened the public hearing on the Request of the H. Peavy Heirs for rezoning of the rear portion of a lot owned by the heirs of H. Peavy located behind the Brusly Landing Café at 438 N. Vaughan Drive, Brusly, Louisiana from R-1 (Single Family Residential) to C-1 (Light Commercial).

Mr. Skipper Grady represented the family and made the presentation. He stated that having the rear portion of this lot zoned residential hinders the commercial use of the property. There was discussion on the dimensions of the commercial portion.

There was objection from adjacent property owners on the north side of the property and concern for changing the zoning to commercial in an area that is surrounded by residential properties. The limited access to the rear portion of the property due to the location of improvements on the commercial portion was pointed out by members of the Peavy Family as a detriment to any possible sale of the rear portion as a residential.
Mr. Don Neisler advised the members of the commission to consider the permitted uses in C-1 (Commercial) and how any one of these uses could affect the area.

Mrs. Claudette Purnell asked members of the Peavy, Alexander and Griffin families if a compromise could be made between the families whereas the use of the private drive owned by the Alexander and Griffin families could be utilized for the Peavy property. This was not considered as an option. There were no further comments. The public hearing was closed.

Mr. Carroll Fontenot made a motion to recommend to the Town Council that the zoning should remain as is. Mr. Jules Thibodaux seconded the motion and it carried by a six to one vote. Yeas: Jules Thibodaux, Carroll Fontenot, Debbie Thompson, Rosa Stelly, Henry Couvillon, Leslie Crockett. Nays: Claudette Purnell.
2. The public hearing was opened for comments on the Ordinance to amend and re-enact Article B (Zoning) of Chapter 19 of the Code of Ordinances of the Town of Brusly, Louisiana. Mr. Don Neisler was recognized and gave a synopsis of the changes:

• Housekeeping and terminology update like: Board to read Brusly Town Council; Trailer Parks to read Mobile Home Parks; Filling Stations to read Service Stations. There were no comments on these changes.

• Added responsibilities for: Mayor, Council, Zoning Commission, Building Official, Board of Adjustment. There were no comments on this item.

• Deleted definitions or reference to “swimming pool” under accessory uses as per council action. There were no comments on this change.

• Added actual street names for arterial and collector streets, rather than reference type only. No comments were received on this change.

• Defined proper location of group homes in multi-family district. No comments received on this change.

• Limited maximum area of garages and sheds under accessory uses and house additions to 450 sq. ft. or 20% of the principle structure with a maximum total being 150% of the original square footage and for all and disallowing tubs and showers. There was some discussion on this change but no objections were received.

• Added definitions for: Adult facilities: exotic dancing; massage parlors; Cemetery; Concrete crushers; House addition; Manufactured or Mobile Homes; Video Poker/Truck Stops. Two changes were noted on this item: Page 8, section #2 add the word means after store and before an establishment; Page 9, section #17 remove phrase “of any retail liquor establishment selling low or high alcoholic beverages” from line 3.

• Rewrote provisions for non-conforming uses to be easier understood. No comments were received on this item.

• Added a column to setback table showing minimum living area under residential classifications. No comments were received on this item.

TEXT USE CHANGES:

• Eliminated the F.F. district. No FEMA flood zones in Brusly currently. No comments received.
