MINUTES OF BRUSLY PLANNING COMMISSION
SPECIAL MEETING
MARCH 12, 2003

A special meeting of the Brusly Planning Commission was held on March 12, 2003 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 5:30 P.M.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson, Rosa Stelly, Henry Couvillon, Claudette Purnell.

Members absent: Leslie Crockett.

Others present: Marianne Berthelot, Mayor Joey Normand, Joanne Bourgeois, Ronda Perrault, Darryl Babin, Chris Kershaw, Don Neisler, Jamie Fontenot, Mr. & Mrs. Dane D’Armond, Mr. & Mrs. Danny Rabalais, Norris Decoteau, Jeff Decoteau, Christie Peck, and a group of local residents.

Upon motion of Mr. Carroll Fontenot seconded by Mrs. Claudette Purnell, the minutes of the February 25, 2003 special meeting were approved as written. Motion carried unanimously.

This special meeting was called for a Public Hearing and final action on the “Final Plat of Orleans Quarters Subdivision (First Filing)”.

The Chairperson opened the Public Hearing at 5:34 P.M.

Mayor Joey Normand was recognized. He referred to his letter dated February 25, 2003 recommending acceptance of the first filing of Orleans Quarters Development’s final plat. (A copy of his letter of recommendation is attached to and made part of the minutes of the Special Meeting of the Planning Commission held on February 25, 2003).

The Chairperson recognized those who wished to speak: Mr. Henry Melancon, Mr. Skipper Grady, Mr. Mike Martinez. The following concerns were discussed:

1. Definition of and the use of the term “Access Servitude” vs. “Public Right of Way”.

Adjoining property owner Henry Melancon questioned the use of the term “Access Servitude” vs. Public Right of Way. He was concerned that unless it was dedicated as a “Public Right of Way” with the Town having Fee Title, his use of these servitudes could be limited. Engineers for the Developers defended the use of this term.

Ms. Jamie Fontenot, Legal Counsel for the Town of Brusly was asked for an opinion and she advised that she felt comfortable with the use of the term “Access Servitude” and in no way would this limit the use of the servitudes for public streets.

2. Wording in Restrictions regarding use of the Access Servitudes. (Orleans Quarters Subdivision Restrictions, Section VIII – Adjoining Property).

Mr. Skipper Grady had concerns that the developers of Orleans Quarters Subdivision were placing restrictions on the development of adjoining property upon their use of the “Access Servitudes”. He was assured by the Developers that this was not their intention. Ms. Christie

Peck, Legal Counsel for the developers suggested that in order to help clarify the intention the following phrase “except via a public road through the 50’ Access Servitudes #1, #2 or #3” as shown on the final plat of Orleans Quarters Subdivision” could be added.

3. Upon development of adjoining property to the North will the public road connect to Allene Street?

Mr. Mike Martinez questioned if development of the Melancon Property would tie in a public road to Allene Street. Mr. Melancon answered that he had no plans to go past the Orleans Quarters Street with a public road upon development of his property.

The Chairperson asked if anyone else wished to speak. There were none. Mr. Carroll Fontenot made a motion to close the Public Hearing. Motion was seconded by Mr. Jules Thibodaux and carried unanimously. The Public Hearing closed at 6:10 P.M.

Mrs. Rosa Stelly made a motion to recommend approval of the Orleans Quarters Final Plat (First Filing) contingent upon the addition of the suggested revision to clarify the deed restrictions by adding the phrase “except via a public road through the “50’ Access Servitudes #1, #2 or #3, as shown on the final plat of Orleans Quarters Subdivision”. Motion was seconded by Mr. Henry Couvillon and carried unanimously.

There was no other business to come before the Planning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Motion was seconded by Mrs. Claudette Purnell and carried unanimously.

The Special Meeting of the Brusly Planning Commission adjourned at 6:15 P.M.
