Town Meeting Minutes – Monday, April 14, 2014

The regular meeting of the Town of Brusly was held this date, April 14, 2014 at the Brusly Town Hall.

Council Member André led the Pledge of Allegiance. A roll call determined the following officials present:

Mayor: Joey Normand
Council Members: Scot Rhodes, Joanne Bourgeois, Terry Richard, Shane André,
Don Neisler
Town Attorney: Thomas Acosta, Jr.
Absent: None

A motion to approve the minutes of the Town’s regular meeting of March 10, 2014, was made by Council Member André and seconded by Council Member Bourgeois. Mayor Normand opened the floor for public comment. Hearing no comments, the motion passed with a unanimous vote.
Public Works Committee: None
Planning and Zoning Committee:
Mayor Normand read aloud a Variance Request for Non-Compliance – Sec. 19.6 Servitude Encroachment for Brusly Oaks Homeowners Assoc. for lot 3 of Brusly Oaks Subdivision to build a fence. The Variance having been favorably recommended by the Planning & Zoning Commission, a motion to approve was made by Council Member Bourgeois; seconded by Council Member Neisler. The Mayor opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Mayor Normand presented the final plat of Stonewall Plantation, Phase 1 (A Traditional Neighborhood Development) Located in Sec. 58, Township 8 South, Range 10 East Southeastern Land District, West of the Mississippi River, Town of Brusly, West Baton Rouge Parish, State of Louisiana for Stonewall Plantation, LLC. Upon Mayor Normand’s recommendation a motion to approve conditional upon the completion of the punch list was made Council Member André; seconded by Council Member Richard.
The Mayor opened the floor for public comment. Hearing no comments, the motion passed unanimously.
Inasmuch as a family member of the Mayor’s is employed by the developer, Mayor Normand asked Mayor Pro Tempore Rhodes to approve completion of the punch list and sign the final plat. He agreed to do so.
Finance Committee:
Upon Mayor Normand’s recommendation a motion to approve the signing of a contract with Executone for phones in the new Police Station was made by Council Member Bourgeois; seconded by Council Member Neisler. The Mayor opened the floor for public comment. Hearing no comments, the motion passed unanimously.
Personnel Committee:
Upon Mayor Normand’s request a motion to hire a temporary part time maintenance worker, conditional on Council final approval at the next meeting, was made by Council Member Richard; seconded by Council Member André. The Mayor opened the floor for public comment. Hearing no comments, the motion passed unanimously.

Consideration of Vetoed Ordinances: None
Hearing and Final Action on Ordinances:
Ordinance #1 of 2014 –Chapter 15 Flood Damage Prevention was read aloud and opened for Public Hearing by Mayor Normand. Hearing no comments from the public, Mayor Normand turned the issue over to the Council for Consideration. A motion to adopt Ordinance #1 of 2014 was made by Council Member André; seconded by Council Member Rhodes. A roll call vote was had with the following result:

Absent: None

Introduction of Ordinances:
Council Member Bourgeois introduced Ordinance __ of 2014 – Chapter 2 – Code of Procedure for Mayor’s Court, 2.92 – Method & Time of Appeal.
Council Member Neisler introduced Ordinance __of 2014 – 2013/2014 Budget Adjustments – Town.
Resolutions and Commendations:
Mayor Normand read aloud Resolution #2 of 2014 Adopting the WBR Parish All Hazards Emergency Plan. A motion to adopt was made by Council Member Rhodes; seconded by Council Member Richard.
The Mayor opened the floor for public comment. Hearing no comments, the motion passed unanimously.
Fire Department Report:
Fire Chief Alleman gave the Fire Chief’s report for March. There were ten (10) first aid calls inside the Town and ten (10) outside of Town. There was one (1) fire inside and none outside of Town. There was

one (1) investigation, one (1) natural gas leak and one (1) grass fire. There were eight (8) motor vehicle crashes. The total calls for the month were thirty-two (32). The total for the year is seventy-nine (79).
Police Department Report:
Police Department Report for the month of March was given by Sgt. Robertson. There were fifteen (15) wrecks, sixteen (16) bench warrant arrests, three (3) alarms, one (1) juvenile matter, seventeen (17) traffic arrests and twenty (20) miscellaneous calls. For the month’s total, there were 72 calls, 235 citations and 311 violations.

Mayor’s Report:
Mayor Normand reported the population estimate for the Town of Brusly is now at 2,705. The Mayor attended the Rotary District Convention, at the WBR Museum, during which General Russell Honoré spoke. Inspired by the General’s speech, the Mayor announced that the Town of Brusly would now be showing preference to hiring veterans for future job openings. Mayor Normand and Council Member Bourgeois attended the Keep WBR Beautiful State Initiative to better inform the public about littering on April 11. Mayor Normand also attended the Landmark & Heritage Plaque Ceremony on April 13.
Remarks of Personal Privilege:
Council Member Bourgeois thanked the Town’s Staff for their helping preparing for the Landmark & Heritage Plaque Ceremony. WBR Parish Council Member Kershaw gave a brief update on Parish projects.
Announcements:
Town Hall Closed April 18th for Good Friday.
Landmark & Heritage Meeting April 21st at 6:30 PM.

At the request of Assistant District Attorney Tony Clayton, a motion to move into to executive session to discuss investigative proceedings concerning allegations of misconduct was made by Council Member Bourgeois; seconded by Council Member André. The Mayor opened the floor for public comment. Hearing no comments, a roll call vote was had with the following result:
Yeas: Rhodes, Richard, André, Bourgeois, Neisler
Nays: None
Absent: None
The Council and Mayor Normand went into executive session at 6:52 PM.

A motion to come out of executive session was made by Council Member André; seconded by Council Member Bourgeois. The Mayor opened the floor for public comment. Hearing no comments, a roll call vote was had with the following result:
Yeas: Richard, André, Bourgeois, Neisler, Rhodes
Nays: None
Absent: None
The Council and Mayor Normand returned from executive session at 7:45 PM.

A motion was made by Council Member André to adjourn; seconded by Council Member Richard. Hearing no comments, the motion passed with a unanimous vote. The meeting adjourned at 7:46 PM.
