Town Meeting Minutes – Monday, July 13, 2015

The regular meeting of the Town of Brusly was held this date, July 13, 2015, at the Brusly Town Hall, at 6:30 p.m. Council Member Richard led the Pledge of Allegiance. A roll call determined the following officials present:

Mayor: Joey Normand
Council Members: Scot Rhodes, Joanne Bourgeois, Terry Richard, Shane André, Don Neisler
Town Attorney: Thomas Acosta, Jr.
Absent: None

A motion to approve the minutes of the Town’s regular meeting of June 8, 2015, was made by Council Member Bourgeois and seconded by Council Member Richard. Mayor Normand opened the floor for public comment. Hearing no comments, the motion passed with a unanimous vote.

Public Works Committee:
Mayor Normand recommended the substantial completion from Barber Brothers Construction for the Street Overlay Project in the amount of $251,773.80. A motion to accept substantial completion was made by Council Member Andrè; seconded by Council Member Neisler. Mayor Normand opened the floor for public comment. Hearing none, the motion passed unanimously.

Planning and Zoning Committee:
Mayor Normand read aloud a Variance Request for Non-Compliance – Sec. 19.31.1 Zoning District R-1 reducing the Side Setback from 10’ to 4’ for Alton Loupe Jr. 3229 Live Oak Dr. to build a shop. The Variance having been favorably recommended by the Planning & Zoning Commission, a motion to approve was made by Council Member Richard; seconded by Council Member Andrè. Mayor Normand opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Mayor Normand read aloud a Variance Request for Non-Compliance – Sec. 19.31.1 Zoning District R-1 reducing the Side Setback from 10’ to 6’ for Alton Loupe Jr. 3313 Live Oak Dr. to build an accessory structure. The Variance having been favorably recommended by the Planning & Zoning Commission, a motion to approve was made by Council Member Bourgeois; seconded by Council Member Neisler. Mayor Normand opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Mayor Normand read aloud a Variance Request for Non Compliance – Sec. 18.13 (c) Accessory Structure/Uses for Richard Lane at 616 Lyon St. to allow an accessory structure to contain a shower. The Variance having been favorably recommended by the Planning & Zoning Commission, with the condition that no bath tub be included in the structure, a motion to approve was made by Council Member Rhodes; seconded by Council Member Andrè. Mayor Normand opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Mayor Normand presented the Final Plat of Map Showing Subdivision of the Original H.H. Peavy Property into Lots “A” & “B” Located in Sec. 13, T8S, R12 East Southeastern Land District West of the Mississippi River, Town of Brusly, West Baton Rouge Parish, Louisiana for William E. Beatty III & Dyan Hebert Beatty. Having been favorably recommended by the Planning & Zoning Commission, a motion to approve the subdivision was made by Council Member Bourgeois; seconded by Council Member Neisler. The Mayor opened the floor for public comment. Hearing no comments, the motion passed unanimously.

Mayor Normand opened the Condemnation Hearing of 1146 West Main Street (Lot JW-1). Upon the request of Maurice Hall, the attorney representing the estate of James & Henrietta Woods, a motion to delay the hearing until the meeting of August 10, 2015 was made by Council Member Andrè; seconded by Council Member Bourgeois. The Mayor opened the floor for public comment. Hearing no comments, the motion passed unanimously.

Mayor Normand opened the Condemnation Hearing of 229 St. John Street. Upon the request of Marla Dickerson, the court appointed attorney representing the heirs of Alfred Brown, a motion to delay the hearing until the meeting of August 10, 2015 was made by Council Member Andrè; seconded by Council Member Richard. The Mayor opened the floor for public comment. Hearing no comments, the motion passed unanimously.

Personnel Committee: None

Recreation Committee:
Mayor Normand requested authorization to sign Cooperative Endeavors with the following entities for the purpose of allocating budgeted recreational funds as approved by the Town:
WBR Parish School Board – $3,000.00
Brusly High School Panther Paws – $500.00
WBR Foundation for Academic Excellence – $500.00
Panther Wrestling Club – $2000.00
A motion to approve was made by Council Member Andre’; seconded by Council Member Neisler. The Mayor opened the floor for public comments. Hearing no comments the motion passed unanimously.

Mayor Normand requested authorization to add $4,500.00 to the Cooperative Endeavor with WBR Parish School Board for the purchase of youth football equipment which is not included in the budgeted recreational funds previously approved by the Town. A motion to approve was made by Council Member Bourgeois; seconded by Council Member Richard. The Mayor opened the floor for public comments. Hearing no comments the motion passed unanimously.

Police Committee:
Police Chief Jonathan Lefeaux presented Officer Jason Fontenot with the “Officer of the Year Award” for his outstanding performance and tremendous commitment to the Brusly Police Department.

Mayor Normand congratulated Chief Lefeaux and Officer Fontenot, stating that the combination of good management and Officers like Fontenot has resulted in exceeding the year’s projections.

Hearing and Final Action on Ordinances: None

Introduction of Ordinances: None

Resolutions and Commendations:
Resolution #9 of 2015 to request congressional reform of the process of planning & constructing vital infrastructure projects where federal funding is potentially involved was read aloud by Mayor Normand. After a brief discussion a motion to approve with the wording changes was made by Council Member Neisler; seconded by Council Member Richard. Mayor Normand opened the floor for public comment. Hearing no comments, the motion passed unanimously.

Police Department Report:
Police Department Report for the month of June was given by Chief Lefeaux. There were eight (8) alarms, three (3) animal calls, six (6) assists to other agencies, one (1) burglary, two (2) civil matters, three (3) disturbances, one (1) domestic call, one (1) hit & run, two (2) information calls, one (1) medical emergency, one (1) miscellaneous call, one (1) other, one (1) suspicious vehicle, three (3) thefts, five (5) traffic accidents, two (2) traffic complaints, sixty-three (63) traffic stops and one (1) warrant arrest. For the month’s total, there were 106 calls, 351 citations, 476 violations, 49 insurance tows and twelve (12) driving under suspension arrests.

Mayor’s Report:
Mayor Normand reported the Town of Brusly estimated population from the Treasurer’s Office is at 2,833. The Mayor also reported that Maintenance Worker John Devillier left the Town of Brusly employment in good standing, accepting a job elsewhere for the betterment of his family. Mayor Normand announced that despite the large amount of rainfall in the month of June, no house flooding or sewer backups had occurred. The Mayor invited everyone to view the updated Veteran’s Memorial Display in front of the Town Hall. Mayor Normand attended a Parish sponsored class on GIS computer mapping.

Remarks of Personal Privilege:
Members of the public expressed their concerns about the availability of sand and sandbags during flooding emergencies. Council Member Bourgeois thanked Chief Lefeaux and Reserve Officer LeRay for their assistance to an Allene St. resident during a recent heavy rainfall event. Parish Council Member Kershaw gave a brief update on WBR Parish projects.

Announcements:
The Landmark & Heritage Meeting will be July 20th at 6:30 PM.

A motion was made by Council Member Andrè to adjourn; seconded by Council Member Richard. Hearing no comments, the motion passed with a unanimous vote. The meeting adjourned at 7:15 PM.
