Town Planning & Zoning Meeting Minutes – Wednesday, July 22, 2015

MINUTES OF THE BRUSLY PLANNING & ZONING COMMISSION MEETING
JULY 22, 2015

The regular meeting of the Brusly Planning & Zoning Commission was held this date, July 22, 2015, at the Brusly Town Hall. Chairman LeMoine called the meeting to order at 6:30 PM.
Commissioner Guidry led the Pledge of Allegiance. A roll call determined the following officials present:
Chairman: Kim LeMoine
Commissioners: Steve Guidry, Ronda Perrault, Claudette Purnell, Gary Soniat, Jeff Travasos
Absent: Steve Perkins
Others present included Rosa Stelly, Cletus Langlois, Don Neisler and Joanne Bourgeois.

A motion to approve the minutes of June 24, 2015 regular meeting of the Planning & Zoning, as written, was made by Commissioner Perrault and seconded by Commissioner Soniat. The minutes were approved unanimously.

Variance Request:
Chairman LeMoine read aloud the Variance Request from Arthur & Whitney Soma at 2610 Orleans Quarters Dr. for Non-Compliance – Sec. 19.6 Servitude Encroachment – to build a patio. After determining that culverts had been installed, Commissioner Soniat offered a motion to recommend approval to the Town Council; seconded by Commissioner Travasos. The motion passed unanimously.
Variance Request:
Chairman LeMoine read aloud the Variance Request from Aaron Daniel at 409 E. Main St. for Non-Compliance – Sec. 19.31(a)(2)(a) Buffer Zones – to be exempt from fencing & shrubs around the buffer zone for security purposes. Commissioner Perrault reported that Police Chief Lefeaux was in favor of the variance. After a brief discussion, Commissioner Travasos made a motion to recommend approval to the Town Council; seconded by Commissioner Purnell. The motion passed unanimously.
Variance Request :
Chairman LeMoine read aloud a Variance Request for Non Compliance – Sec. 19.23 Right-of-Way for Stonewall Plantation, LLC to allow trees in a dedicated drainage & utility right-of-way. Mr. Cletus Langlois, representing Stonewall Plantation, LLC presented the variance request. After a brief discussion, a motion to recommend the variance to the Town Council was made by Commissioner Perrault; seconded by Commissioner Guidry. The motion passed unanimously.
Public Hearing: Final Plat with Variance Request:
Chairman LeMoine read aloud the Request for Removal of Lots A-4.1.B.1 & A-4.1.B.2 from Lot A-4.1.B (of Lynn J. Pourciau Tract) Located in Sec. 14, T-8-S, R-12-E, S.E. Land District, West of the Mississippi River Town of Brusly, Parish of West Baton Rouge State of La. For Sherry Elizabeth Lopez Pourciau and Non-Compliance – Sec. 19.8(a)(5)k – to allow more than 500 feet distance from the edge of the street right-of-way to the end of the private servitude of access. Chairman LeMoine opened the Public Hearing. Mr. Cletus Langlois, representing Ms. Pourciau, presented the plat to the Commission and offered to answer any questions posed. After discussion, Chairman LeMoine closed the Public Hearing. A motion to recommend approval of the plat and variance to the Town Council, contingent upon a sufficient water main being installed the entire length of Richard Street with a fire hydrant at the end, along with a letter from the Fire Chief stating it was adequate for fire protection to the lots and a letter stating that the lot at 212 Richard Street will be allowed to tie into the main sewer line, was made by Commissioner Perrault; seconded by Commissioner Travasos. A roll call vote was had with the following results:
Yeas: Guidry, LeMoine, Perrault , Purnell, Soniat
Nays: None
Abstained: Travasos
Absent: Perkins
Public Hearing: Final Plat with Variance Request:
Chairman LeMoine read aloud the Request for Resubdivision of the Remainder of Lot A-4.1.B (of Lynn J. Pourciau Tract) into Lots A-4.1.B.3 & A-4.1.B.4 Located in Sec. 14, T-8-S, R-12-E, S.E. Land District, West of the Mississippi River Town of Brusly, Parish of West Baton Rouge State of La. For Sherry Elizabeth Lopez Pourciau and Non-Compliance – Sec. 19.8(a)(5)k – to allow more than 500 feet distance from the edge of the street right-of-way to the end of the private servitude of access. Chairman LeMoine opened the Public Hearing. Mr. Cletus Langlois, representing Ms. Pourciau, presented the plat to the Commission and offered to answer any questions posed. Commission Guidry pointed out that Sec. 19.8(a)(5)k reads “The maximum distance from the edge of the street right-of-way to the end of the private servitude of access shall be no more than 500 feet, but in no case shall contain more than four (4) residential lots, including the lot fronting on the street.” After a discussion, Chairman LeMoine closed the Public Hearing and a motion to table the request until a variance for having more than four (4) lots from the edge of the street right-of-way to the end of the private servitude of access is submitted, was made by Commissioner Guidry; seconded by Commissioner Purnell. A roll call vote was had with the following results:
Yeas: LeMoine, Perrault, Purnell, Soniat, Travasos, Guidry

Absent: Perkins

A motion was made by Commissioner Purnell to adjourn; seconded by Commissioner Travasos. The motion passed with a unanimous vote. The meeting adjourned at 7:40 PM
