MINUTES OF THE BRUSLY PLANNING COMMISSION
April 26, 2006
A regular meeting of the Brusly Planning Commission was held on Wednesday April 26, 2006 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:30 PM.
Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson,
Rosa Stelly, Shane Sarradet, Claudette Purnell.
Members absent: Steve Perkins.
Others present: Marianne Berthelot, Don Neisler, Mayor Joey Normand,
Joanne Bourgeois, Ronda Perrault, Chris Kershaw,
Donnie Jarreau, Jim Tatum, Joel Tingle, and a group
of approximately 40 citizens from the Brusly Oaks Subdivision
and Back Brusly area.

Upon motion of Mrs. Rosa Stelly seconded by Mr. Jules Thibodaux, the Minutes of the March 22, 2006 meeting were approved as written. Motion carried unanimously.
The Chairperson opened the Public Hearing on the following request for resubdivision:
Map showing resubdivision of Tract X-1-B and Tracts X-3, X-4 & X-5-D into Tracts X-1-B-1, X-1-B-2 & X-1-B-3 and Tracts X-3-A & X-4-A located in Sections 15 & 16, T8S, R12E, SLD, WBR Parish being a portion of the Additions to Cinclare Plantation.
Mr. Jim Tatum of Tatum Engineers presented the request and answered questions from the commission members and the audience. There was no opposition to this request.
Mr. Carol Fontenot made a motion to close the Public Hearing. Mr. Shane Sarradet seconded the motion and it carried unanimously.
Mrs. Rosa Stelly made a motion to recommend that the Town Council approve the request for resubdivision of Tract X-1-B and Tracts X-3, X-4 & X-5-D into Tracts X-1-B-1, X-1-B-2 & X-1-B-3 and Tracts X-3-A & X-4-A located in Sections 15 & 16, T8S, R12E, SLD, WBR Parish being a portion of the Additions to Cinclare Plantation. Mrs. Claudette Purnell seconded the motion and it carried unanimously.
Under other business, Mr. Joel Tingle submitted a request for approval of the following resubdivision plat:
“Final Plat of Map Showing the Survey of the Subdivision of Lot B into Lots B-1 and B-2 of the Phyllis B. Mulkey Estate located in Section 56, T8S, R12E, Town of Brusly, WBR Parish. He advised that there is an existing 25’ servitude of passage to the property along the North property line and a 15’ servitude dedicated for utilities is along the South property line.
Mrs. Claudette Purnell made a motion to send this request to Public Hearing. Mr. Shane Sarradet seconded the motion and it carried unanimously. The public hearing will be held on May 24, 2006.
There was no other business to come before the Planning Commission.
Mr. Carol Fontenot made a motion to adjourn. Mr. Jules Thibodaux seconded the motion and it carried unanimously.
The meeting of the Planning Commission adjourned at 6:40 PM.

MINUTES OF BRUSLY ZONING COMMISSION
April 26, 2006
A regular monthly meeting of the Brusly Zoning Commission was held on Wednesday April 26, 2006 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:40 PM.
Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson,
Rosa Stelly, Shane Sarradet, Claudette Purnell.
Members absent: Steve Perkins.
Others present: Marianne Berthelot, Don Neisler, Mayor Joey Normand, Joanne Bourgeois, Ronda Perrault, Chris Kershaw, Donnie Jarreau, Jim Tatum, Joel Tingle, and a group of approximately 40 citizens from the Brusly Oaks Subdivision and Back Brusly area.

The Chairperson opened the Public Hearing on the following rezoning requests submitted by Donnie Jarreau:
Request for Rezoning from C-1 & R-1 to R-6.
Property Description: Western Portion of Tract X-4-A
Owner: The Oaks S.C. LLC / Ace Holdings, LLC
Proposed use of property: Town Homes
Request for Rezoning from C-2 to R-4.
Property Description: Eastern portion of X-4-A
Owner: The Oaks S.C. LLC / Ace Holdings, LLC
Proposed use of property: Apartments
Mr. Jim Tatum with Tatum Engineers presented the request for Mr. Jarreau. He displayed the resubdivision map recommended for approval during the Planning Commission portion of this meeting to show Tract X-4-A and explain how the proposed project would transition from the existing Strip Mall commercial properties to R-4 Apartments to R-6 Town Homes. He pointed out that the water retention pond and the electric transmission line right of way acts as a buffer between the proposed site and the Brusly Oaks Subdivision. The Illustrative Perspective site plan of the Apartments and Town Homes was also displayed and he advised that Mr. Jarreau plans to make this a gated community of town homes and upscale apartments.
Upon conclusion of his presentation, the Chairperson asked for comments and questions. Following are items discussed:
Size of Town Homes? Will range from 1300 – 1500 square feet and will
sell for approximately $120 to $125 per square foot.
Apartment rent? Will range from $800 to $1,000 per month.
How many units? 36 Town Homes and 64 Apartments.
Parking spaces? As required by ordinance.
Other items of concern were : additional traffic during peak hours, on site management and restrictions, effect on schools, effect on property values in area, rental or leasing of town homes.

The audience was made up of approximately 90% homeowners in the Brusly Oaks Subdivision and the majority of those homeowners had concerns regarding the proposed apartments. Several times during the discussion, Mr. Jarreau was asked by some of these homeowners to reconsider his proposed project eliminating the apartments and building all town homes.
The pros and cons of apartments and town homes verses all town homes was discussed at length. The homeowners were reminded by the Chairperson that the existing zoning of C-1 and C-2 allows for numerous types of businesses to locate on the property without input from the public. The Chairperson read the ordinance for C-1 and C-2 zoning at this time.
A question was asked regarding the procedure for approval of rezoning requests and what options did the public have if they are in opposition. Mrs. Thompson explained that the Planning and Zoning Commission only makes recommendations to the Town Council which is the final authority. At this time Mayor Joey Normand was recognized. He explained that anyone who wished to pursue opposition would be able to do so during the Town Council Committee Meeting held on the first Monday of the month. He further explained that the official Town Council meeting where action is taken and voted upon is held on the second Monday of the month and the floor is not open for comments at this meeting. He urged those present to attend the committee meeting and make their opinions known to the Town Council Members.
Commission member Rosa Stelly asked Mr. Jarreau if he would be opposed to reconsidering his request for rezoning the eastern portion of lot X-4-A to R-4 (Apartments). He advised that he would agree to the request for reconsideration and look into the matter however, he asked that the commission take action on his request for rezoning of the western portion of Lot X-4-A to R-6 Town Homes. (A copy of the legal description of the Western Portion of Tract X-4-A is attached and made part of these minutes).
Mrs. Claudette Purnell made a motion to close the public hearing. Mr. Jules Thibodaux seconded the motion and it carried unanimously. The Chairperson called for a motion on the request.
Mrs. Rosa Stelly made a motion to recommend that the Town Council approve the rezoning of the western portion of Lot X-4-A to R-6 (Town Homes) and table the request for rezoning of the eastern portion of lot X-4-A to R-4 (Apartments). Mr. Shane Sarradet seconded the motion. Motion carried with a roll call vote of six (6) yeas, (Mr. Thibodaux, Mr. Fontenot, Mrs. Thompson, Mrs. Stelly, Mr. Sarradet, Mrs. Purnell). Mr. Steve Perkins was absent and not voting.
There was no other business to come before the Zoning Commission.
Mr. Carol Fontenot made a motion to adjourn. Mr. Jules Thibodaux seconded the motion and it carried unanimously.
The meeting of the Zoning Commission adjourned at 8:00 PM.
