MINUTES OF THE BRUSLY PLANNING COMMISSION
DECEMBER 20, 2006
A regular meeting of the Brusly Planning Commission was held on Wednesday December 20, 2006 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Mrs. Debbie Thompson, Chairperson at 6:30 PM.
Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson,
Rosa Stelly, Shane Sarradet.
Members absent: Claudette Purnell, Steve Perkins.
Others present: Marianne Berthelot, Mayor Joey Normand, Don Neisler,
Joanne Bourgeois, Raymond Loup, Jason Creighton.
Upon motion of, Mr. Carroll Fontenot seconded by Mrs. Rosa Stelly, the Minutes of the November 29, 2006 meeting were approved as written. Motion carried unanimously.
The Final Plat of the Gates at the Oaks Subdivision (1st and 2nd Filings) was taken up for review and recommendation. A letter of recommendation from the Mayor was provided to the members stating that all requirements have been met with the exception of DHH approval that is pending.
There was some discussion on the 2nd filing that is the gated portion of the subdivision. Mr. Don Neisler was recognized. He advised the commission that upon further review, it is his opinion that since the Subdivision Regulations do not specifically address gated subdivisions, this portion of the subdivision technically falls under Sec. 19-8 “Subdivisions not fronting on a Public Street” but do not meet the requirements as stated in Item (5) –k of Sec. 19-8 and recommended that a variance should be granted on Lots 13 through 29.
Discussion followed and Mrs. Rosa Stelly suggested that the ordinance should be amended to address “Gated Subdivisions” for future developments. It was the consensus of all the members present that the Town Council should consider reviewing this.
The Secretary advised members that the “Buyer Beware” statement for Lots 13 through 29 was added to the plat as requested. She also stated that the developers were asked to add the municipal addresses on the final plat for all lots, numbers 1 through 29, and noted several typos that needed correction.
Mrs. Rosa Stelly made a motion to recommend that the Town Council approve the Final Plat of The Gates at the Oaks Subdivision 1st Filing, Lots #1 -12 and the 2nd Filing, Lots #13 -29 contingent upon receipt of DHH approval and grant a variance on the gated portion of the 2nd filing for the number of lots not fronting on a public street and the distance of the private street. (Section 19-8 – (5) – k – Subdivision Regulations). Mr. Carroll Fontenot seconded the motion and it carried unanimously.
There was no other business to come before the Planning Commission.
Mr. Carroll Fontenot made a motion to adjourn. Mr. Jules Thibodaux seconded the motion and it carried unanimously.
The meeting of the Planning Commission adjourned at 6:45 PM.
