MINUTES OF THE BRUSLY PLANNING & ZONING COMMISSION MEETING
September 25, 2013
The regular meeting of the Brusly Planning & Zoning Commission was held this date, September 25, 2013 at the Brusly Town Hall. Chairperson Rosa Stelly called the meeting to order at 6:30 PM.
Commissioner LeMoine led the Pledge of Allegiance. A roll call determined the following officials present:

Absent: Jeff Travasos, Steve Perkins
Others present included Joanne Bourgeois, Don Neisler, Joey Normand, Genevieve O’Neil, Loretta Blanchard and Cletus Langlois.
A motion to approve the minutes of the Planning & Zoning regular meeting of August 28, 2013 as written was made by Commissioner Purnell and seconded by Commissioner Perrault. The minutes were approved unanimously.

Chairperson Stelly opened the Public Hearing on the proposed Final Plat showing the Re-subdivision of a parcel of land located at 958 W. Main St. into SBG-1 and SBG-2 located in Sec. 14, Township 3 South, Range 12 East S.E. Land District west of the Mississippi River, Town of Brusly, Parish of WBR, State of Louisiana for Shirley Boudreaux Guidry ET. ALS. The Chair recognized Mr. Cletus Langlois, representing Shirley Guidry. Mr. Langois presented the plat and variance request.
Commissioners posed questions and expressed concerns about an existing building located directly on the proposed property line, the front property line facing the wrong direction, the lack of a utility servitude running the entire length of the property and the possibility that the existing accessory structure is an inhabitable structure, in violation of Town Ordinances.
Mayor Normand informed the Chair that his recommendation to the Town Council will be to take no action on the proposed re-subdivision until it is determined if the accessory structure is being used as a residence at the location, in violation of the Town’s Ordinances.
Chairperson Stelly directed Patricia Gaudet to read the list of requirements that were not met on the presented map. After hearing the requirements that were not met on the plat, Mr. Langlois suggested he make changes to the map and resubmit it at next month’s meeting.
Chairperson Stelly closed the public hearing. A motion to table the issue was made by Commissioner Perrault; seconded by Commissioner Soniat. A roll call vote was had with the following results:

Chairperson Stelly read aloud a Variance Request for Non Compliance – Sec. 19.31.1 Zoning District R-1, Front Setback for Shirley Boudreaux Guidry ET. ALS. at 958 W. Main St. to encroach upon the front building line by 14.6’. Being in conjunction with the previous plat, a motion to table was made by Commissioner LeMoine; seconded by Commissioner Purnell. A roll call vote was had with the following results:

Absent: Travasos, Perkins
Chairperson Stelly read aloud a Variance Request for Non Compliance – Sec. 19.6 Drainage Servitude Encroachment for Genevieve A. O’Neil at 2598 Orleans Quarters Dr. to encroach upon the servitude by 5’ 9” for the purposes of building a patio on the rear of her house and a shed. Chairperson Stelly recognized Ms O’Neil, who explained the request. After a brief discussion, a motion to recommend the variance to the Town Council was made by Commissioner Perrault; seconded by Commissioner LeMoine. A roll call vote was had with the following results:

Nays: None
Absent: Travasos, Perkins

A motion was made by Commissioner Perrault to adjourn; seconded by Commissioner Soniat. The motion passed with a unanimous vote. The meeting adjourned at 7:01 PM.
